These Terms and Conditions govern the use of the real estate crowdlending platform operated by Observadorar S.A.S. By using our services, you accept these terms in their entirety.

1. Definitions

"Platform" refers to the website observadorar.com and all its associated services. "User" is any person who accesses or uses the Platform. "Investor" is the User who participates in crowdlending projects. "Project" is each real estate venture published on the Platform.

2. Eligibility

To use the Platform you must: be at least 18 years old, have legal capacity to enter into contracts, reside in Argentina or have an Argentine CUIT, provide truthful and up-to-date information, and comply with all applicable laws.

3. Registration and Account

To invest in projects, you must create an account providing accurate information. You are responsible for maintaining the confidentiality of your credentials and all activities performed with your account. You must notify us immediately of any unauthorized use.

4. Nature of Service

Observadorar S.A.S. operates as an intermediary between investors and real estate developers. We do not guarantee the success of any project or the return on investment. Investments in crowdlending carry significant risks, including the possible total loss of invested capital.

5. Investment Risks

Before investing, you should consider: the inherent risks of the Argentine real estate market, the possibility of partial or total loss of capital, the illiquidity of investments during the project term, macroeconomic factors that may affect returns, and specific risks of each project detailed in its documentation.

6. User Obligations

You agree to: provide truthful and up-to-date information, use the Platform only for lawful purposes, not attempt to access restricted areas of the system, not engage in activities that may harm the Platform, and comply with all applicable regulations.

7. Intellectual Property

All content on the Platform, including texts, graphics, logos, images, software, and databases, is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without express authorization.

8. Limitation of Liability

To the maximum extent permitted by Argentine law, Observadorar S.A.S. shall not be liable for: losses arising from investments in projects, service interruptions, errors or omissions in content, indirect, incidental, or consequential damages, and actions of third parties.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the Platform. Continued use of the service after modifications constitutes acceptance of the new terms.

10. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Argentine Republic. Any dispute shall be submitted to the ordinary courts of the Autonomous City of Buenos Aires, waiving any other jurisdiction that may correspond.
